🔐 Terms and Conditions – Vista Web

1. Acceptance
The payment of an initial deposit constitutes acceptance of the terms and conditions. The client confirms having read, understood, and accepted all clauses contained in this document before proceeding with the initial payment.

2. Payment and Terms
A minimum deposit of 50% may be required to begin a project, unless otherwise agreed upon.

The balance is due upon final delivery, or according to the schedule agreed upon by the parties.

Invoices are payable within 60 days of the invoice date.

In case of non-payment after 60 days, an interest fee of 2% per month (24% annually) will be added to the balance owed until full payment is made.

Vista Web reserves the right to suspend any service in case of non-payment.

3. Web Hosting
Vista Web offers monthly and annual hosting packages, depending on the client's needs.

For a monthly plan, the agreement will automatically renew each month until canceled.

For an annual plan, the client commits to a minimum duration of 12 months from the first payment.

Any cancellation of the plan must be submitted in writing at least 30 days before the renewal date.

No refund will be provided for hosting periods already paid, even if the client decides to stop using it before the end of the period.

Exceeding space usage (extra usage)
In case of exceeding the space included in the selected plan, Vista Web will charge for each additional gigabyte at the current rate. The client will be notified once usage reaches 90% of the allocated capacity.

4. Production Deadlines
Delivery deadlines are provided as estimates and may vary depending on project complexity, the client's availability to provide necessary materials (texts, images, access, etc.), or other circumstances beyond our control.

Vista Web is not responsible for delays caused by third parties or unforeseen events.

5. Client-Provided Content
The client agrees to provide content that is either copyright-free or for which they hold the necessary permissions.

Vista Web is not responsible for lawsuits or claims related to unauthorized content provided by the client.

6. Intellectual Property
All elements created by Vista Web remain the property of Vista Web until full payment for the project is made.

Once final payment is received, the client becomes the owner of the delivered elements, unless stated otherwise (e.g., licensed software, third-party licensed photos).

7. Post-Delivery Modifications
Any modification or addition requested after the delivery of the site or completion of the initial assignment will be subject to additional charges, based on the current hourly rate or a previously agreed-upon package.

8. Limitation of Liability
Vista Web commits to providing its services diligently and professionally. However, its liability is limited to the value of the paid services.

Vista Web is not responsible for lost revenue, technical failures, hacking, service interruptions, or other indirect damages related to the use of the delivered services.

9. Termination
The client may terminate the contract at any time, in writing. However, any amounts already billed or due for services rendered up to the termination date must be paid.

Vista Web reserves the right to terminate a contract in case of non-compliance with these terms, non-payment, or if the client's behavior hinders the successful execution of the project.

10. Applicable Law
These terms are governed by the laws in effect in the province of Quebec. Any disputes will be submitted to the competent courts of the judicial district where the headquarters of Vista Web is located.
